Cary Ichter is a Partner in the Commercial Litigation practice with Ichter Thomas, LLC. A trial lawyer who primarily handles commercial disputes, Cary’s clients include national franchise companies, which he represents both regionally and nationally. He also has litigated disputes between manufacturers and distributors throughout the country, with cases in New York, New Jersey, California, Minnesota, Wisconsin, and Puerto Rico. Cary has considerable experience litigating employment disputes, including claims under Title VII and the Age Discrimination Employment Act, as well as claims of sexual harassment. His practice also includes disputes involving restrictive covenants ancillary to employment agreements and trade secret misappropriation actions. He has successfully litigated cases involving copyright infringement involving computer software and musical recordings.

EXPERIENCE

  • Tried over twenty-five (25) jury trials to conclusion, representing everything from airlines to web design companies to Internet service providers. These cases have involved a wide range of issues, including franchise relationships, sexual harassment, software licensing, real estate contracts, and professional wrestling.
  • Represented several international franchise brands on a national basis, including quick service restaurants, athletic footwear and apparel stores, and hotel chains. On a regional basis, Cary has represented franchisees in the child care market.
  • In a case against an area developer who breached its development agreement, Cary successfully defended franchisors against developer claims, obtained an $850,000 award and collected that award.
  • Successfully arbitrated a commercial products liability claim on behalf of a furniture company that received defective coated products and sustained a substantial commercial injury.
  • Defended and prosecuted the claims of minority shareholders in closely held corporations in arbitration and jury trials.
  • Defended and prosecuted claims made under the Uniform Commercial Code related to the purchase and sale of allegedly defective equipment.
  • Prosecuted claims on behalf of the owners of intellectual property for copyright infringement and for the breach of licensing agreements.
